Kentucky's Financial Responsibility Law is now mostly about judgments

Open KRS Chapter 187, the Financial Responsibility Law, and most old sections read "Repealed." What remains centers on court judgments from crashes.

Under KRS 187.410, the Transportation Cabinet suspends your license and registration once it receives a certified copy of a judgment. That covers judgments for injury, death or property damage from owning or using a vehicle. Nonresidents lose their Kentucky operating privilege the same way.

The suspension has no end date until the debt is resolved

KRS 187.420 keeps the license and registration suspended until every judgment is stayed, satisfied or discharged. No new license goes out in your name meanwhile, even if you were never licensed before.

Very large judgments have a ceiling for this purpose. KRS 187.430 treats them as satisfied once payments equal to the statutory amounts are credited. Settlement payments for the same crash count toward those amounts.

Installments plus proof: the route back under KRS 187.440

You can ask the court that entered the judgment to let you pay in installments. Notice to the person you owe comes first. Under KRS 187.440, the Cabinet restores your license when you give proof of financial responsibility and obtain that order.

The restored license lasts only while no installment is in default. Miss one, and the Cabinet suspends you again until the judgment is satisfied. The person you owe can also consent in writing. The Cabinet can then allow your license for six months, and longer until that consent is revoked.

What the proof has to cover in Kentucky

KRS 187.290 defines the proof as ability to pay for crashes after its effective date. The amounts must meet KRS 304.39-110.

The Cabinet's mandatory insurance page spells those out. You need $25,000 per person and $50,000 per crash for injury, plus $25,000 for property. A single limit of $60,000 is also acceptable. The policy must include basic reparations benefits, the no-fault part, unless the vehicle is a motorcycle.

Insurers report every personal policy to the Cabinet each month. A Kentucky-registered vehicle must be insured by a company authorized in Kentucky.

A Kentucky DUI interlock license asks for an insurance card

Drivers suspended for DUI follow a different track. The Kentucky Ignition Interlock Program lets eligible drivers shorten the suspension by driving with an approved device. The application is form TC 94-175.

Its checklist asks for proof of valid registration and a proof of insurance card, not a judgment-style filing. You pay the $40 reinstatement fee at a Driver Licensing Regional Office when the restricted license is issued.

Paying the $40 fee does not reinstate you by itself

The reinstatement page says any suspension may require a $40 reinstatement or re-licensing fee. In-state holders can pay through myDrive. You can also pay at a Regional Office or by phone. Mailed payments go by certified check or money order to the Kentucky State Treasurer.

Every suspension requirement must be met before privileges return. A suspension longer than one year adds vision and written tests.

Kentucky drivers also ask

Can the person I owe let me keep driving in Kentucky?

Yes. Under KRS 187.410, the judgment creditor can consent in writing. The Cabinet can then allow your license for six months, and after that until the consent is revoked in writing.

What happens if I miss a court-ordered installment?

KRS 187.440 has the Cabinet suspend your license, registration or nonresident privilege again. It stays suspended until the judgment is satisfied.

Do I have to test again after a long suspension?

Only if it ran more than one year. Then vision and written tests come first, and the $40 fee must be paid before your testing appointment.
