Driving uninsured is what usually puts an SR22 on a Utah record

The Driver License Division says a conviction for driving without insurance, or without proof of it, mandates a suspension. It also requires an SR22 filing. Three other situations bring the same demand:

  • An uninsured vehicle registered to you is in an accident.
  • A court orders damages after an uninsured accident.
  • You hold a Driving Privilege Card and fail to show proof of security.

The division tells you by mail, so your address on file has to be current. The offense itself is costly. The DMV insurance page calls it a Class B misdemeanor. The fine is at least $400 the first time and $1,000 for a repeat within three years.

Only an AAMVA Financial Responsibility Form counts

Utah is strict about the paper itself. The division accepts only the AAMVA form clearly titled "Financial Responsibility Form" at the top. The date beside the signature can be no more than 30 days old. A company licensed in Utah has to issue it.

Your insurer or agent is required to submit it. Insurers use the division's SR22 portal, which takes certificates and SR26 notices in real time. An SR26 is the notice a company sends when the policy ends. Carriers pay nothing to sign up. You can also send a copy by email or fax, or hand it in at a local office.

Three years from the conviction, with your license on the line

The division counts the period from the date of conviction, typically three years. Your own letter sets the exact length, since it varies by the reason for the filing.

State law makes DPS keep your proof on file for a three-year period, according to the DMV. Your insurer must report a terminated policy to DPS. If you were convicted and then drop coverage, you must surrender your driver license. Apply again within three years of the original requirement, and DPS needs fresh proof before reissuing it.

The 2025 jump in Utah liability minimums

Check the limits on any policy carrying your SR22. Under Utah Code 31A-22-304, a policy issued or renewed on or after January 1, 2025 needs $30,000 for one injured person. It needs $65,000 for two or more people and $25,000 for property damage. A single $90,000 limit per accident also qualifies.

Older policies carried $25,000, $65,000 and $15,000, or $80,000 combined. Utah also requires No-Fault coverage on top of liability. A nonresident's car that spends 90 days in Utah within 365 days must carry it too.

One fee for each action on your license, another for your plates

The reinstatement page charges a fee for each department action against you. A no-insurance conviction costs $40.00, and so do a points suspension and a cleared failure to appear. An alcohol or drug offense is $85.00, plus a $262.00 administrative fee.

Your registration is a separate matter at the DMV. Restoring revoked plates costs $100. A current SR-22 from a Utah-licensed insurer is one accepted proof of coverage. The fee is waived if you prove the vehicle was insured on the revocation date.

Utah drivers also ask

Is the SR22 in Utah a separate insurance policy?

No. It is a certificate from a Utah-licensed insurer verifying that your policy is active. It proves you meet the state insurance law.

I have three tickets on my Utah record. Do I pay three reinstatement fees?

The division can charge one fee for each department action, or citation. Points, no insurance and a cleared failure to appear are $40.00 each.

What happens if my SR22 policy is canceled early?

Your insurer notifies DPS that the policy ended. After a no-insurance conviction, you then have to surrender your license to DPS.
